General Terms and Conditions
1. Scope
1.1. These terms of use govern the contractual relationship between the association Bewerbeagentur ("bewerbeagentur") and the users of Bewerbeagentur's services, particularly the e-learning programs and other training or educational offerings ("Training"), including the training materials provided electronically or otherwise in this context ("Training Materials").
1.2. By registering for a training offered by bewerbeagentur through bewerbeagentur's website at www.bewerbeagentur.ch or applicationbootcamp.ch ("Website"), the user accepts these terms of use.
2. Services of bewerbeagentur
2.1. Bewerbeagentur provides its services to the participant in accordance with this usage agreement, as well as the current descriptions of the training published on the website and the specific terms and conditions applicable to each training.
2.2. The trainings are continuously developed and adapted by the Bewerbeagentur. The Bewerbeagentur reserves the right to modify the content and conduct of trainings on a case-by-case basis if it can better achieve the respective training goal. In this case, the participant is not entitled to a refund of the paid participation fee.
2.3. The Bewerbeagentur provides the participant with the training materials used in the trainings. The provisions regarding the use of services in accordance with clause 3 and the provisions regarding intellectual property in accordance with clause 6 of these terms of use apply.
2.4. The Bewerbeagentur may use or refer to products or publications of third parties in the trainings. The Bewerbeagentur assumes no responsibility for these products or publications of third parties.
3. Use of Services
3.1. The participant acknowledges that the training offered by Bewerbeagentur and the training materials provided are solely for educational purposes.
3.2. The training offered by Bewerbeagentur is intended solely for the personal and non-commercial use of the participant. The provided training materials may not be distributed, whether for a fee or free of charge, or made available to third parties, nor may they be used in any of the participant's own training projects.
3.3. Bewerbeagentur conducts the trainings exclusively digitally as webinars and also provides the training materials online via the internet.
3.4. The participant undertakes to treat the access data provided by the Bewerbeagentur for accessing the trainings and training materials confidentially and not to disclose them to third parties. Persons other than the participant are not authorized to access, view, disseminate, or use the trainings or training materials, whether electronically or in printed form.
3.5. Bewerbeagentur reserves the right to block the participant's access to trainings and training materials with immediate effect and to exclude the participant from ongoing trainings in the event of breaches of these provisions regarding the use of Bewerbeagentur's services. Compensation for any damages incurred remains reserved.
4. Rescheduling, Cancellation, Transfer
4.1. For rescheduling and cancellation of a training by the participant (self-payer), the following conditions apply:
a. More than 21 days before the start of training:
Rescheduling: Free of charge
Cancellation: 20% of the cost
b. Between 21 days and 7 days before the start of training:
Rescheduling: 20% of the cost
Cancellation: 50% of the cost
c. Less than 7 days before the start of training:
Rescheduling: 50% of the cost
Cancellation: 100% of the cost
4.2. Transfer of registration to a third party is only possible with the prior consent of the Bewerbeagentur. The right to participate is generally personal to the registered participant.
5. Payment Terms
5.1. The participation fee is generally to be paid in advance upon registration in exchange for a confirmation of participation and receipt. Bewerbeagentur uses a suitable electronic payment method for processing (e.g., credit card, PayPal, or Twint).
5.2. Payment by invoice is only possible in exceptional cases and only with prior consent from Bewerbeagentur. Unless otherwise indicated on the invoice, a payment deadline of 20 days, strictly net, applies. Unauthorized deductions will be charged back.
5.3. Objections to an invoice must be communicated to Bewerbeagentur in writing, stating reasons, no later than 10 days after receipt. Otherwise, the respective invoice will be considered accepted.
5.4. If the participant has neither paid an invoice from Bewerbeagentur within the deadline nor validly claimed rescheduling or cancellation, nor raised objections accepted by the Bewerbeagentur, the Bewerbeagentur may put the participant in default through a reminder.
5.5. In the event of default, Bewerbeagentur may demand statutory default interest from the participant or exclude the participant from attending trainings or accessing further services.
5.6. The participant bears all costs that could arise for Bewerbeagentur due to the participant's payment default, such as administration and collection costs (especially reminder fees), as well as legal or court costs.
6.Intellectual Property
6.1. The copyrights and all other rights to intellectual property in the trainings, the know-how conveyed in the trainings, and the training materials provided remain with Bewerbeagentur.
6.2. Unless expressly provided by these terms of use or special agreement, the participant does not acquire any rights, title, or licenses to the trainings, the know-how conveyed in the trainings, or the training materials provided.
6.3. The participant is granted a non-exclusive and non-transferable right to use for personal use only. The know-how conveyed in the trainings and the training materials provided may not be sublicensed or sold in whole or in part. The sharing of the provided training materials is only allowed with prior written consent from Bewerbeagentur.
6.4. The participant is not allowed, without prior written consent from the Bewerbeagentur, to reproduce or publish the provided training materials, in whole or in part, including in edited form.
6.5. Making image and/or sound recordings during a training without prior written consent from Bewerbeagentur or the respective trainer is not permitted.
7. Liability and Insurance
7.1. Bewerbeagentur is liable only for intent and gross negligence. Otherwise, liability is completely excluded.
7.2. Bewerbeagentur cannot be held liable for damages resulting from the participant's careless handling of electronic access data.
7.3. Should booked trainings be unable to take place or be cancelled due to force majeure, such as sudden illness or accident of a trainer, no claims can be made against the Bewerbeagentur.
8. Privacy policy
8.1.The participant acknowledges and agrees that Bewerbeagentur collects, stores, and processes the participant's data as part of its business activities. The separate privacy policy listed below applies.
9. Reservation of Changes
9.1. Bewerbeagentur reserves the right to amend these terms of use with reasonable advance notice at any time. The terms of use in effect at the time of registration for each respective training shall apply.
9.2. Changes to these terms of use will be communicated to the participant in an appropriate manner and shall be deemed approved by the participant without objection upon participation in the next training.
10. Final Provisions
10.1. Should individual provisions of these terms of use be invalid, ineffective, or unenforceable, this shall not affect the validity of the remaining provisions and of these terms of use.
10.2. The invalid, ineffective, or unenforceable provisions shall be replaced by valid, effective, and enforceable provisions that come as close as possible to the invalid provisions in their economic significance.
11. Applicable Law, Jurisdiction
11.1. These terms of use, as well as the services provided by the Bewerbeagentur in connection with these terms of use, are subject exclusively to Swiss law.
11.2. The application of the United Nations Convention on Contracts for the International Sale of Goods dated April 11, 1980 ("Vienna Sales Convention") is expressly excluded.
11.3. For the adjudication of disputes arising from or relating to these terms of use or the services provided by the Bewerbeagentur in connection therewith, the ordinary courts at the registered office of the Bewerbeagentur shall have exclusive jurisdiction. However, the Bewerbeagentur may also bring claims before the ordinary courts at the participant's place of residence, at its discretion.
Data protection regulation
Scope
1.1. This privacy policy governs the use and processing of user data in connection with the website and all subpages under the domain www.bewerbeagentur.ch and www.applicationbootcamp.ch ("Website").
1.2. The operator of the website is the association BEWERBEAGENTUR (referred as "bewerbeagentur").

3.2. If you register third parties for a workshop/course, you guarantee the accuracy of the transmitted personal data as well as your authorization to register and provide the personal data of these third parties to bewerbeagentur. B. Cookies
3.3. We use cookies for statistical analysis of our website. Cookies are files that can be stored on the hard drive of your computer. They help us tailor our website to your needs. If you do not wish this, you only need to disable the acceptance of cookies in your browser. C. Google Analytics
3.4. bewerbeagentur uses Google Analytics or similar services on its website. These are third-party services that may be located in any country worldwide (in the case of Google Analytics, it is Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA, google.com), which allow bewerbeagentur to measure and evaluate the use of the website (non-personally identifiable). 3.6. For your registration and the entire administration process, we require the following data from you in particular: first and last name, address, telephone, email, date of birth, marital status, nationality, AHV number, billing address, and CV.
3.7. All personal data collected via bewerbeagentur's website can be merged with data about the same person that you have provided to bewerbeagentur in another context, e.g., during a workshop/course. B. Disclosure to Third Parties
3.8. bewerbeagentur uses your data to enable third parties in Switzerland and abroad to perform technical, logistical, or other services on our behalf. When we disclose or otherwise transmit your personal data to third parties, we do so if it is necessary for the purpose of contract processing or billing, or to provide technical services for our website.
3.9. In individual cases where data is transferred abroad to countries that do not have equivalent data protection to Switzerland, we will ensure compliance with the necessary data protection provisions in an appropriate manner, e.g., contractually, with the third parties. C. Individual Marketing and Advertising Purposes
3.10. The data you transmit and that is automatically generated by our IT systems is also used to recommend workshops/courses tailored to you and your interests.
3.11. Our goal is to make our advertising more useful and interesting for you. Therefore, the evaluation and analysis of the data collected from you help us ensure that we do not send you advertising at random.
3.12. If you no longer wish to receive personalized advertising from bewerbeagentur, you can object to this at any time. A message to info@bewerbeagentur.ch is sufficient for this purpose.
Security Measures
4.1. bewerbeagentur implements appropriate technical and organizational security measures to prevent loss, misuse, or alteration of information and personal data transmitted by the user. However, the user is aware that uncertainties may still exist with transmissions over the Internet.
Rights of use
5.1. The user may at any time request that bewerbeagentur provide them with a copy of the personal data concerning them or provide information about its use. Furthermore, bewerbeagentur will correct or delete this data upon the user's request, provided that there are no legal obligations preventing bewerbeagentur from doing so.
